Respondents PRAYER Writ Petition has been filed under Article 226 of the Constitution of India, praying to call for records in the lease auction notice dated 27.11.2025 issued by the 4th Respondent, and to quash the same illegal, without jurisdiction and to consequently forbear the respondents from interfering with the peaceful possession and enjoyment of the land by the petitioner, admeasuring an extent of 1.15 acres, in S.No.219/ 10, Melpattampakkam, Panruti Taluk, Cuddalore District. For Petitioner: Mr.M.Manimaran For Respondent: Mr.N.R.R.Arun Natarajan, Spl.G.P(HR & CE) for R1 to R4 Mr.A.M.Ayyadurai, GA for R5 ORDER The writ petition is filed challenging the impugned notice dated 27.11.2025 and quash the same and consequently to forbear the respondents from interfering with the peaceful possession and enjoyment of the land. 2.Upon hearing the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4 and the learned Government Advocate for the fifth and perusing the affidavit and the material records of the case, it is seen that the petitioner claims title through one Sulochana ammal. It is also further stated that Sulochama ammal had filed O.S.No.248 of 2007 on the file of the District Munsif Court, Panruti against one Kannayan, Ramasamy, Azhaganantham, the District Collector, Cuddalore, Tahsildar, Panruti and the suit is decreed in her favour. 3. The learned counsel for the petitioner further submits that subsequently when the District Revenue Officer ordered mutation of patta in the name of the Endowment namely, Keelmadam, the same was challenged in W.P.No.1209 of
2024.
As a matter of fact, when the entire area has been laid out and divided into plots and was being sold by the petitioner, suddenly the impugned notification for auction was published. 4. Mr.N.R.R.Arun Natarajan, learned Special Government Pleader (HR & CE) would submit that the order passed by the Revenue Divisional Officer dated 02.11.2022 itself decides that the patta shall be in the name of the Keelmadam, which is an endowment attached to Arulmigu Vettai Venkataraya Perumal Thirukovil and therefore, the temple has right, title and interest over the property and then, they are giving on auction, the petitioner cannot approach this Court and stall the same. 5. When the petitioner is setting up a rival title as against the temple, the question of title, whether the land in question was Inam land or not, even if it is an Inam land, whether the right, that is granted to the vendor of Sulochana ammal, namely, Velthanigai Subramania Iyyar, was devadayam or with both Melvaram and Kudivaram, whether the alienation by the said person and thereafter, by Sulochana ammal is valid or not and whether any orders have been passed by the Settlement Tahsildar with reference to the instant property or not, cannot be gone into in the present writ petition. It is for the parties to file a civil suit and agitate their respective title. 7. The learned counsel for the petitioner submits that when the petitioner’s vendor has already approached the civil Court and established the title, the petitioner need not be driven once again to file a civil suit.
A perusal of the cause title categorically shows that some private individuals and the Collector and the Tahsildar, are only made as parties, neither the endowment nor the temple as a party in the suit and as such it can be held to be binding on the temple. Therefore, keeping open the remedies of the parties, to take such steps, in the manner known to law, the Writ Petition cannot be entertained. https://www.mhc.tn.gov.in/judis

8. Accordingly, the Writ Petition is disposed of. No costs.
