HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8415 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 234 of 2025, under Sections 103(1) and 238 BNS, P.S. Jaisinghpur, District Sultanpur. 3. It is argued by learned counsel for the applicant that in terms of FIR it was alleged that daughter of the informant had committed suicide on 26.6.2025 on account of harassment faced at the instance of accused named in the FIR. Subsequently after investigation, the applicant was deemed accused on the basis of post mortem report. It is argued that in the post mortem report, a view was recorded that the cause of death was ante mortem strangulation. Learned counsel for the applicant argues that in the post mortem report itself, the hide bone was found to be intact which is not possible in the event of strangulation. Reliance has been placed upon extracts from the Modis Textbook of Medical Jurisprudence and Toxicology. 4. Considering the said submissions coupled with the fact that the applicant is in custody since 8.7.2025 and has no criminal antecedents, prima facie there is no material to suggest that if the applicant is enlarged on bail, he can adversely affect the trial. 5. Learned AGA has opposed the bail application. Versus Counsel for Applicant(s) : Sukh Deo Singh, Paritosh Shukla Counsel for Opposite Party(s) : G.A. Parveen Bano .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko .....Opposite Party(s) 6. Considering the facts and circumstances, however, without commenting upon the merits of the case, the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed. 7. Let the applicant Parveen Bano be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
