HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9604 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 2. The applicant seeks enlargement on bail in FIR No.213 of 2025, under Section 137(2), 65(1) of BNS and Section 3/4 (2) of POCSO Act, Police Station Mahmudabad, District Sitapur. 3. The FIR in question was lodged alleging that the daughter of the informant aged about 12 years was alone when she was enticed by the applicant. Subsequently in the statement under Section 180 of Cr.P.C., the victim stated that she had gone to meet the applicant. She also stated that nothing wrong was committed with her. In the statement under Section 183 of BNSS, there are huge variance and for the first time, she stated that wrong was committed with her. The medical report on record does not corroborate any allegation of force being used. The tentative age of the victim is 14 years as per the medical examination report. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the huge variance in the statements of the victim coupled with the fact that the medical does not corroborate the allegations and the fact that the applicant has no criminal antecedents and is languishing in jail since 14.06.2025, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed. Versus Counsel for Applicant(s) : Narendra Gupta Counsel for Opposite Party(s) : G.A. Neeraj @ Sippu .....Applicant(s) State Of U.P. Thru. Secy.
