HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1572 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in F.I.R No.232/2025, U/S-115(2), 351(3), 109 Β.N.S., Police Station- Purwa District - Unnao. Heard learned counsel for the applicant and learned A.G.A. for the State. In the prosecution case, it is alleged that on 26.06.2025 at about 4:00 p.m., a cow belonging to one Rajkishore (applicant) had fallen down. On this pretext, it was alleged that the son of the complainant had hit the cow with a tractor, whereupon the named accused persons assaulted the complainant’s son with lathi and danda, causing him serious injuries. Learned counsel for the applicant submits that cross FIRs have been lodged by both sides and that members of both parties have sustained injuries. It is contended that the applicant has been falsely implicated in the present case. Learned AGA and learned counsel for the complainant have opposed the bail application. From a perusal of the case diary and the material on record, it appears that the applicant along with three co-accused persons is alleged to have inflicted grievous injuries upon the injured. The learned Sessions Court, while rejecting the bail application, has duly considered the injury report. The Versus Counsel for Applicant(s) : Desh Deepak Verma Counsel for Opposite Party(s) : G.A., Deepak Kumar Raj Kishor Yadav .....Applicant(s) State Of U.P Thru. Prin. Secy. Home Lko. record indicates that the injured remained admitted in SGPGI from 26.06.2025 to 01.07.2025. The doctor has opined that the injuries were on vital parts of the body and that the injured could have succumbed to those injuries. The injury was found to be a right frontal extradural hematoma with left parietal depressed fracture accompanied by underlying extradural hematoma. In view of the gravity of the injuries sustained by the victim and the material collected during investigation, it does not appear to be a case of false implication. Accordingly, the application for anticipatory bail is rejected. October 28, 2025 R.C.
