This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 191(2), 191(3), 190, 117(2), 118(2), 109, 303(2), 324(4), 329(4), 352, 351(2) and 351(3) of BNS.

The allegation against these petitioners is that they have brutally assaulted and seriously injured the informant with lathi, gadasa, sword when his father, son and labourers were making construction on the site.

The learned APP opposes the prayer for anticipatory bail.

After going through the F.I.R. and impugned order, I find that there is direct allegation of assaulting the informant by this petitioner. I have gone through the injury report. Though there are injuries, but it cannot be said that there was any intention to commit murder.

However, considering the direct allegation of assault, I find that
this is not a fit case for grant of anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners in connection with Dandai P.S. Case No.28 of 2025, pending in the Court of learned Judicial Magistrate, 1st Class, Garhwa, stands rejected.

The instant anticipatory bail application stands dismissed.
