HON'BLE MR. JUSTICE SUDESH BANSAL Order 08/01/2025
1. No one has appeared on behalf of petitioner. 2. Instant writ petition was filed by and on behalf of petitioner way back on 17.01.2014, challenging the order dated 08.04.2011 passed by the Rajasthan Civil Services Appellate Tribunal, Jaipur, dismissing his appeal No.1303/2002. 3. From perusal of previous order-sheets, it appears that petitioner has not pursued the writ petition, after filing of same and today as well, no one has put in appearance, therefore, the
[2025:RJ-JP:1098] (2 of 2) [CW-1396/2014] writ petition is being considered and decided on merits as per material available on record. 4. It appears from the record that the petitioner was appointed on the post of Mixer Operator in Mahi Project, Banswara and after completion of that project, he was re-engaged on Bisalpur Project, Deoli (Tonk). Petitioner claimed for grant of pay scale which he was obtaining in the Mahi Project, Banswara. His claim has been declined by the Tribunal with findings that in the order of re-engagement, he has accepted the condition of re-engagement having no lien of service in the Mahi Project, Banswara and has accepted grant of pay-scale payable in Bisalpur Project. The pay- scale for the post of Mixer Operator in the Bisalpur Project, Deoli (Tonk) is different than Mahi Project, Banswara, therefore, the petitioner was not held entitled to claim the pay-scale of Mahi Project, Banswara, while having his re-engagement in the Bisalpura Project, Deoli (Tonk) in a different pay-scale. 5.
In the opinion of this Court, the reasons assigned by the Tribunal, to decline the claim of petitioner and to dismiss the appeal are justified and do not suffer from any perversity or jurisdictional error, as such the same do not warrant any interference by the High Court in exercise of its jurisdiction under Article 227 of the Constitution of India. 6. Accordingly, the writ petition is devoid of merits and the same is hereby dismissed. (SUDESH BANSAL),J TN/67
