Heard Mr. S.C. Biswas, learned counsel appearing for the petitioner. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor appearing for the State. By this application, the petitioner has prayed for bail in connection with Dholai
Page No.# 2/3 P.S. Case No. 120/2025 under Section 140(1)/3(5) of BNS, 2023. The FIR dated 10.09.2025 reveals that the accused person had brought down the brother of the informant from the bus and took him away in a vehicle on the suspicion that he is involved in some drug business. Mr. S.C. Biswas, learned counsel appearing for the petitioner submits that the name of the petitioner is not mentioned in the FIR. However, the petitioner was arrested and in the forwarding report, his name was reflected as one of the accomplices i.e., one of the accused persons who had taken away the brother of the informant after bringing him down from the bus. He further submits that the petitioner was a known person while lodging the FIR but then his name was not reflected in the same and that he has no involvement in the said offence. Mr. B. Sharma, learned Addl. Public Prosecutor however submits that the accused persons along with the petitioner is alleged to have manhandled the brother of the informant on some suspicion without taking recourse to other authorities as required under the law. Upon consideration of the submissions made by the counsels and upon perusal of the FIR as well as the forwarding report more so in absence of specific allegation against the petitioner, this Court finds it fit that the petitioner may be released on bail on furnishing of a bail bond of Rs.
20,000/-(Rupees twenty thousand) with one (1) local surety of the like amount to the satisfaction
Page No.# 3/3 of CJM, Cachar, Silchar under the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the CJM, Cachar, Silchar as and when called for. 2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the CJM, Cachar, Silchar without prior permission of the said Court.
