Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 2 23/01/2025 1) Learned counsel for the petitioner submits that petitioner is a resident of Village Jata, Tehsil Jaijaipur, District- Janjgir Champa (C.G.). He further submits that Gram Panchayat Bhothiya consists of two villages- Bhothiya and Jata; distance between them is 500 meters but there is no direct approach between the villages because of two ponds, namely, Bandhwa Talab and Barsati Nala. He further contends that Gram Panchayat Bhothiya and Janpad Panchayat Jaijaipur passed a resolution for construction of road, culvert and retaining wall but till date, no action has been taken and matter remains pending before the Zila Panchayat, Janjgir which is the competent authority to release the fund. He prays that the authority concerned may be directed to look into the matter and take appropriate action. 2) On the other hand, learned State counsel opposes. 3) Heard. 4) Taking into consideration the fact that earlier resolution has been passed by Gram Panchayat Bhothiya and Janpad Panchayat Jaijaipur which has been forwarded to Zila Panchayat, Janjgir but till date, no action has been taken, this petition is disposed of directing CEO, Zila Panchayat, Janjgir to take appropriate decision on resolution passed by Gram Panchayat Bhothiya and Janpad Panchayat Jaijaipur expeditiously. 5) Accordingly, instant writ petition stands disposed of.
