Hussain, learned counsel appearing for the accused petitioners as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, (1) Jackeston Sangma (2) Baner Sangma (3) Binachan Teron (4) Small Sangma @ Smollester Sangma, praying for grant of bail in connection with Jalukbari P.S. Case No.379/2025 under Sections 109 /112 /303(2) /62 of the BNS Act. 3. The allegations in the ejahar dated 04.09.2025 is that during emergency night duty on 03.09.2025, the informant found four individuals luring stray dogs with biscuits and upon sufficient enquiry, it was found that these persons were allegedly luring dogs with the intention to capture and sell them to other States. 4. I have perused the contents of the penal provision given at this stage. Section 112 pertains to new offence of “Petty Organized Crime” incorporated in BNS. 5. Case diary has been received and I have seen the progress of investigation. The accused persons were arrested on 04.09.2025 and presently are in judicial custody. 6. In the given facts and circumstances, I am of the considered view that the accused persons herein should be granted bail. Page No.# 3/3 7. Accordingly, it is provided that the accused petitioners, named above, shall be released on bail of Rs.15,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate with the remaining investigation. (b) Shall not hamper or tamper with evidence. 8. Accordingly, this bail application stands allowed and disposed of. 9. Return the case diary. JUDGE Comparing Assistant
