The amount in due - 3 - NC: 2025:KHC:11155 WP No. 7065 of 2025 according to the respondent- Bank is Rs.47,00,000/- out of which Rs.10,00,000/- is paid pursuant to the order passed by this Court on 14.03.2025. The issue now is redelivery of possession of the property to the petitioners. 2. Heard Smt. Sandhya U. Prabhu, learned counsel appearing for the petitioners and Shri Vijay S., learned counsel appearing for the respondent. 3. The learned counsel appearing for the respondent - Bank submits that if some more amount is directed to be paid, it would reach the stage of regularisation of the account. 4. The learned counsel appearing for the petitioners at this juncture would undertake that Rs.5,00,000/- would be paid in the next one week i.e., on or before 25.03.2025. 5. The possession of the property shall be restored subject to the aforesaid condition. In the event, the petitioners would breach the undertaking now given to this Court of depositing of Rs.5/- more lakhs, the bank is at liberty to take action in accordance with law, for which purpose the subject order shall be construed to be an order under Section 14 of the - 4 - NC: 2025:KHC:11155 WP No. 7065 of 2025 Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, 2002.
