Syam Sunder Rao, the learned Standing Counsel-cum- Speciai Public Prosecutor for ACB, opposed the petition for relaxation of the conditions on the ground that the petitioner has not filed any document to show that he needs to go to Coimbatore in the State of Tamil Nadu to visit his children. As seen from the record, the petitioner has filed the ID card of his daughter, which shows that she is studying in a college in Coimbatore. It is common knowledge that a parent would incline to visit or see his/her children, when they are studying in any educational institution outside the place where they are residing. The objection of the learned Standing Counsel-cum-Special Public Prosecutor is not sustainable. If the petitioner is allowed to go to Coimbatore and see his daughter, no prejudice would be caused to the Investigating Officer. The condition at Paragraph No.11{iv), that the petitioner shall not leave the States of Telangana and Andhra Pradesh without express permission from the learned Special Judge for SPE & ACB Cases at Kurnool, is hereby relaxed. The petitioner is permitted to travel anywhere within India in case of necessity. However, he shall not leave the Country without prior permission of the Investigating Officer.
