Petitioner is before this Court under Section 438 of Cr.PC seeking anticipatory bail in C.C.No.27032/2022 pending before the Court of V Addl. Chief Metropolitan Magistrate, Bengaluru, arising out of Crime No.53/2019 registered by Kalasipalya Police Station, Bengaluru City. 2. Heard the learned Counsel for the parties. 3. The material on record would go to show that petitioner is arrayed as accused no.4 in the present case and since he had absconded, a split up case has been registered against him in C.C.No.27032/2022. So far as the other accused persons are concerned, the case as against them was committed to the jurisdictional Sessions Court and they are tried in S.C.No.2016/2022. 4. As against the petitioner, in the split up case registered against him, non-bailable warrant as well as proclamation orders have been issued. Under the circumstances, in view of the judgment of the Hon'ble Supreme Court in the case of STATE OF MADHYA PRADESH VS PRADEEP SHARMA - (2014)2 - 3 - NC: 2025:KHC:15063 CRL.P No. 3640 of 2025 SCC 171, petitioner's application under Section 438 Cr.PC cannot be entertained.
