Z. Mazumder, learned counsel appearing for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor appearing for the state respondent. The accused, Raj Ahmed, invoked Section 483 BNSS, 2023, and seeks regular bail in connection with Special (NDPS) Case No. 17/2025, pending before the Court of the Special Judge, Sivsagar. The case arose out of Simulguri PS Case No. 13/2025 under Section 20(b)(ii)(B) of the NDPS Act, 1985. The accused is stated to have been arrested on 24.07.2025. The allegation is of the recovery of 2.480 kgs of suspected ganja from the house of the accused. The said quantity of ganja would fall in the intermediate quantity, and therefore, the rigors of Section 37 of the NDPS Act may not be applicable. Peruse the copy of the charge-sheet available annexed to the bail petition. Considering the fact that the case upon completion of investigation is poised for commencement of trial and also the length of detention, the accused is hereby allowed to go on bail of Rs.30,000/- with one surety of like amount to the satisfaction of the concerned learned court of Special Judge, Sivsagar, and subject to the conditions that:- Page No.# 3/3 (i) That the accused person shall available for the trial; (ii) That the accused person shall not hamper or tamper with evidence; and (iii) That the accused person shall not misuse his liberty to commit any illegal activity or offences. Violation or breach of any conditions shall entail cancellation of bail. With the above observations, this bail petition stands allowed and disposed of accordingly. Return the case diary.
