HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11195 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Krishna Madhav Shukla, the learned counsel for the petitioner, Sri Sandip Srivastava, the learned Additional Chief Standing Counsel appearing on behalf of the State and perused the records.
2. By means of the instant petition filed under Article 226 of the Constitution of India the petitioner has challenged the validity of office memorandum dated 25.09.2023 issued by the State Government declining to include the primary section attached to Sri Vaidik Adarsh Sanskrit Mahavidyalaya, Saryubagh, Ayodhya on grant-in-aid list.
3. Earlier the petitioner had filed Writ-C No.33256 of 2019 before this court claiming that the petitioner institution was imparting education from primary section to postgraduate (Acharya). The teachers teaching in Class 6 onwards were being paid salary from the State ex-chequer but the teachers of primary section were not being paid salary and the primary section was not on grant-in-aid list.
4. The petitioner had applied for including the primary section in grant-in- aid list but when no action was taken on the request the petitioner had filed Writ Petition No.10232 (M/S) of 2016 which was disposed of by means of an order dated 27.11.2018 directing consideration of petitioner's representation. Thereafter the representation was rejected by means of an
order dated 04.04.2019 which rejection order was challenged by filing Versus Counsel for Petitioner(s) : Krishna Madhav Shukla Counsel for Respondent(s) : C.S.C. C/M Sri Vaidik Adarsh Sanskrit Mahavidyalaya Saryubagh Ayodhya Thru. Its Manager Devesh Upadhyay .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Secondary Education Lko. And 2 Others .....Respondent(s)
Writ-C No.33255 of 2019. The writ petition was allowed and the rejection
order was set aside on the ground that it had been passed on the basis of Government Order dated 27.10.2016 which was not applicable to the institution in question and the matter was remanded for being decided afresh. After fresh consideration the State Government has rejected the petitioner's claim by means of office memorandum dated 25.09.2023.
5. The present petition has been filed on 11.11.2025 and there is absolutely no explanation for delay of more than two years in approaching this court challenging the order dated 25.09.2023.
6. Although, no period of limitation is prescribed for filing writ petition, it is settled law that a person invoking extraordinary discretionary writ jurisdiction of this court should approach the court with a reasonable promptitude and in case some delay has occasioned in filing the writ petition the petitioner should furnish sufficient explanation for the delay which has not been done in the present case.
7. Even on merits the impugned order is a detailed well reasoned order wherein it is recorded that the District Inspector of Schools, Ayodhya had inspected the school and submitted a report stating that the petitioner is not recognised for running primary section, the alleged recognition order is ineligible and it does not bear the dispatch number or name of the institution, the classes are not being conducted and there is no separate building for primary section.
8. In these circumstances, there is no good ground to entertain this highly belated petition challenging a well reasoned order dated 25.09.2023. Accordingly, the writ petition is dismissed. November 21, 2025 Ram.
