Heard Mr. J. Singh, learned counsel for the petitioner. Also heard Mr. P. Kataki, learned Special P.P., Vigilance.
2. The learned counsel for the petitioner submits that the petitioner has
Page No.# 2/2 been called by the I/O as witness but he is apprehending arrest as such, the present application has been preferred.
3. Mr. Kataki submits that the petitioner has rightly contended that he has been called as a witness and he has to just join the investigation and that therefore there is no basis for his apprehension of arrest.
4. On the aforesaid submission of the learned prosecutor, I find in the said contention that as the petitioner has been called as a witness in the case, his apprehension of arrest is baseless. Therefore, the petition is not maintainable in the present form. However, petitioner is directed to cooperate with the investigation and shall appear before the investigating authority as and when called for and during the course of appearance, no coercive action may be taken against the petitioner.
5. The present petition stands disposed of on the aforesaid terms.
