Heard learned counsel for petitioner, learned State Counsel for opposite party Nos. 1 to 5 and Mr.Syed Mohammad Haider Rizvi, learned counsel for opposite party No.6 whose power filed today is taken on record. 2. Petition has been filed challenging order dated 22.09.2025 whereby additional charge on the post of Director General Medical Education has been given to an IAS Officer. Further prayer for a direction to the authority concerned to consider petitioner's promotion on the said post of Director General Medical Education has been sought. 3.Learned counsel for petitioner submits that since by means of impugned order dated 22.09.2025 only additional charge on the said post has been given to an I.A.S. Officer the same being contrary to the provisions of Rule 5 read with Rule 8(1) of Uttar Pradesh Medical Education Service Rules, 1990, he is pressing upon his prayer for regular promotion on the said post in terms of the aforesaid Rule since he is senior-most Principal and falls within the zone of eligibility and is qualified for holding the said post. 4. Learned counsel appearing for opposite parties do not have any objection in case a direction is issued to the authority concerned for consideration of petitioner's representation. In view of the submissions advanced and particularly since the order impugned dated 22.09.2025 only provides for additional charge on the post of Director General Medical Education, liberty is granted to petitioner to make a fresh representation before opposite party no.1 i.e. State of U.P. through Additional Chief Secretary, Department of Medical Education and Training, Civil Secretariat, Lucknow to consider and decide his grievance with regard to regular promotion on the post of Director General Medical Education. In case any such representation is preferred, the same shall be considered and decided by the authority concerned, expeditiously, within a period of four weeks from the date of receipt of fresh representation along with a certified copy of this order. 6.
