Heard Mr. S.C. Biswas, learned counsel appearing for the petitioner. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor appearing for the State. Page No.# 2/3 By this application, the petitioner has prayed for bail in connection with Dispur P.S. Case No. 639/2025 registered under Section 316(2)/318(4) of BNS,
2023. The FIR dated 30.07.2025 reflects that a vehicle was given to one Manish Jyoti Das for the purpose of self-drive rented car business by the informant and during the course of the said business, the informant found out that the vehicle was stolen and during the inquiry it was found that the vehicle was misappropriated and sold in the state of Manipur by other persons involved. Mr. Mr. S.C. Biswas, learned counsel appearing for the petitioner submits that the petitioner is the wife of one Deep Roy who is alleged to have been involved in the offence of procuring or stealing vehicles and selling it for unlawful gains in other states. He has placed the grounds of arrest mentioned in the forwarding report wherein it is stated that the petitioner is helping in concealing her husband and that she has also assisted him in delivering those type of vehicle at Manipur. However, he submits that the petitioner has no connection whatsoever in the alleged offence in question. Mr. B. Sharma, learned Addl. Public Prosecutor however submits that the offence of stealing the vehicle and selling it for unlawful gains has been going on and the big racket is involved in the same which includes the petitioner as well.
Page No.# 3/3 Upon consideration of the submissions made at the bar and on the contents of the forwarding report as well as the FIR, it is revealed that there are persons involved in the said offence but the complicity of the petitioner in the said offence is not stated so many words. In view of the same, this Court finds it fit that the petitioner may be released on bail on furnishing of a bail bond of Rs. 20,000/-(Rupees twenty thousand) with one (1) local surety of the like amount to the satisfaction of CJM, Kamrup (M) under the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the CJM, Kamrup (M) as and when called for. 2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the CJM, Kamrup (M) without prior permission of the said Court. The petition is disposed of. JUDGE Comparing Assistant
