Heard learned counsel for the petitioners and learned A.G.A for the State. 2.This court had passed the following order on 16.07.2024:- "Heard learned counsel for petitioner and learned A.G.A. for State. Present writ petition is filed by petitioner for the following primary relief:- "I. Issue a writ order or direction in the nature of Mandamus thereby commanding the Opposite parties to ensure just and proper further investigation of Case Crime No.170 of 2020 P.S. Kotwali Nagar, District Gonda, under Section 419, 420, 467, 468, 471, 379 and 406 I.P.C. lodged in P.S. Kotwali Nagar, Gonda on 29/02/2020 as has been directed by the Chief Judicial Magistrate Gonda through an order dated 03.02.2024 in Miscellaneous Case No.290 of 2022 namely Shambhu lal Vs. Ramji Rastogi and others within stipulated time as this hon'ble court deems fit and proper in the interest of justice." In this case the F.I.R. was lodged on 29.02.2020 and despite the order dated 03.02.2024 passed by Chief Judicial Magistrate, Gonda in Misc. Case No.290 of 2022, the investigation is not concluded as yet. In the said circumstances, respondent no.2-Superintendent of Police, Gonda shall ensure that investigation is positively concluded and police report is submitted within a period of four weeks from today. He shall also ensure filing of personal affidavit with regard to progress made in the investigation Versus Counsel for Petitioner(s) : Madan Gopal Tripathi, Atma Ram Verma, Dalganjan Singh Counsel for Respondent(s) : G.A. Shambhu Lal Kaushal And Others .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Home Sectt. Lko And Others .....Respondent(s) or explaining the reasons for delay in concluding the investigation by the next date failing which he shall be present in Court along with entire record of the case. Put up this case on 27.08.2024." 3. Learned A.G.A., on the basis of instructions submits that final report dated 27.08.2024 has been filed in the court, therefore, this petition has rendered infructuous, which could not be disputed by the other side 4.
