HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 1094 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE RAJEEV BHARTI, J.
1. Heard.
2. The petitioner has filed this petition styled as a public interest litigation seeking, interalia, the relief of debarring opposite party no.10 from participation in the auction to be held on 24.10.2025 for settling of fishery rights pertaining to a pond situated in Village-Kaimaspur, Tehsil-Kadipur, District-Sultanpur. Petitioner is resident of the same village. It is alleged that members of the said Co-operative Society are of the same family which is prohibited under the model by-laws of the Fishery Department. Learned Addl. C.S.C, however, says that if the family members are residing separately then that clause may not apply.
3. Without recording any opinion in the matter, we see no reason to proceed with these proceedings as a public interest litigation rather if there is a cause, petitioner may approach the concerned authorities of the fishery department which registers such co-operative society raising a grievance who may look into the matter as far as it may be required and permissible in law and take such decision as they deem fit as per law but Versus Counsel for Petitioner(s) : Kaushalendra K.
