HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 9205 of 2025 Court No. - 10 HON'BLE RAJNISH KUMAR, J.
HON'BLE ZAFEER AHMAD, J.
1. On an objection raised by learned A.G.A. that the concerned S.H.O has not been impleaded as opposite party in this case, therefore, this petition claiming compensation on account of lodging of the F.I.R under SC/ST Act is not maintainable, learned counsel for the petitioner despite repeated asking failed to implead the S.H.O concerned as opposite party. Therefore, the petition is liable to be dismissed on account of non impleadment of the necessary party because the compensation is being sought in pursuance of the lodging of the FIR at the Police Station Sushant Golf City, District Lucknow South (Commissionerate Lucknow).
2. In view of above, the present writ petition is dismissed with liberty to the petitioner to avail appropriate remedy as may be available in law or file afresh petition.
