ORDER: It is submitted that the respondents have taken advantage of the petitioner’s old age, who is aged about 84 years, and are excavating the gravel from the land of the petitioners. Photographs are also filed, which would indicate that considerable excavation has taken place.
2. Considering the submissions, there shall be a direction to the respondents not to excavate further from the petitioners’ land and in the event the respondents intend to acquire the lands of the petitioners, the same shall be in accordance with the due procedure as laid down under law. It is made clear that the respondents shall not interfere with the petitioners’ lands without following the due process of law.
3. Accordingly, this writ petition is disposed of. There shall be no order as to costs.
