Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking following main relief:- "(i) Issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties (particularly opposite party no. 2,3) to transfer the petitioner or consider her case/request for transfer from the post of Dental Hygienist at the Community Health Centre (CHC), Mustafabad, Bahraich to the currently vacant post of Dental Hygienist at the Community Health Centre (CHC), Sarojini Nagar, Lucknow or else transfer the petitioner/consider her case-request for transfer at any other suitable place within the District Lucknow in view of the reasons/personal difficulties mentioned hereinabove and as the case of the petitioner is also squarely covered by the terms and conditions [clause 5 - specifically clause 5(iii)] of the currently/freshly issued transfer policy dated 06/05/2025 issued by the state government for the annual transfers (2025-26) of officer/employees of the state government (Annexure No.1) forthwith/within specified time." 3. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. The Director General, Department of Medical, Health & Family Welfare, Swasthya Bhawan, Lucknow - or any other competent authority who shall consider and decide the Versus Counsel for Petitioner(s) : Vaibhav Srivastava Counsel for Respondent(s) : C.S.C.
