JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed questioning the order dated 04.03.2023 in I.A.No.II in Crl.Misc.No.347/2021 on the file of the III Additional Principal Family Judge, at Mysuru. 2. This Court by order dated 28.03.2023 had passed an interim order, subject to the petitioner depositing 50% of the arrears i.e., Rs.1,05,000/- and the petitioner has deposited an amount of Rs.52,500/-. It is submitted that Crl.Misc.No.347/2021 itself is dismissed as withdrawn on 26.11.2024. Hence, this petition has become infructuous. He filed I.A.No.1/2025 seeking a direction to refund the amount of Rs.52,500/- deposited before this Court. 3. This submission was made on the last two occasions. As there was no representation on behalf of the respondent, this Court had adjourned the matter on 21.08.2024, - 3 - HC-KAR NC: 2025:KHC:23056 WP No. 7020 of 2023 25.06.2025 and on 26.06.2025 also, there was no representation on behalf of the respondent. Finally, the matter is listed today. Today also, there is no representation on behalf of the respondent. Considering the submission of the learned counsel for the petitioner and looking at the material on record, this Court is passing the following order: ORDER i. I.A.No.1/2025 is allowed and consequently, this writ petition is dismissed as withdrawn. ii. The petitioner is at liberty to withdraw the amount of Rs.52,500/- that is deposited before this Court. iii. All I.As. in this writ petition shall stand closed.
