Heard learned counsel for the petitioner, Mr. Uday Veer Singh, learned Additional Chief Standing Counsel for respondent nos. 3 and 4 and perused the record. Instant petition has been filed with the following reliefs:- "(i). Issue a writ, order or direction or in the nature of mandamus commanding the Respondents to pay the Family Pension to the Petitioner from the date it is due, le 21.10.1976, along with interest payable on the same, within a time frame fixed by this Hon'ble Court; (ii) Issue any other appropriate writ, order or direction in favour of the petitioner as this Hon'ble Court may deem fit i the circumstances of the case. (iii). Award the cost of the petition to the petitioner." After arguing at length, learned counsel for the petitioner submits that the interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the respondent no. 3 to consider and decide the representation of the petitioner dated 20.03.2025 within stipulated period of time as may be fixed by this Court. Learned counsel for the State has no objection to the contention aforesaid. Be that as it may, without entering into the merit of the case, the respondent no.3/District Basic Education Officer, Barabanki, is hereby directed to consider and decide the representation of the petitioner dated 20.03.2025, Versus Counsel for Petitioner(s) : Palash Banerjee, Ankit Kumar Pandey, Aviral Raj Singh, Vaibhav Tiwari Counsel for Respondent(s) : C.S.C., Uday Veer Singh Shanti Devi .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Basic Esu. Lko And 3 Others .....Respondent(s) within a period of two months, in accordance with law, from the date, a certified copy of this order is produced before him.
