HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6173 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Shri Saurabh Yadav, the learned counsel for the petitioners.
2. By means of the instant petition, the petitioners have sought issuance of a direction to the Civil Judge, Senior Division, to decide his temporary injunction application in Civil Suit No.535 of 2025 within a stipulated time and the petitioners have prayed for issuance of injunction order by this Court.
3. A perusal of the order sheet of the trial Court shows that the petitioners have filed the suit for mandatory injunction on 02.09.2025. The trial Court is fixing dates at short intervals. The last order annexed with the supplementary affidavit is of 16.10.2025 on which date, the petitioners were not present before the trial Court.
4. When the trial Court is already fixing dates at short intervals, the petitioners themselves have not attended the proceedings of the trial Court on the last date, there is no good ground to make any interference in this petition for seeking issuance of a direction for expeditious disposal of the suit filed in the last month itself.
5. Accordingly, the instant petition is dismissed at this stage. October 28, 2025 -Amit K- Versus Counsel for Petitioner(s) : Saurabh Yadav Counsel for Respondent(s) :
