The present application under Section 528 Bharatiya Nagarik Suraksha Sanhita (hereinafter referred to as BNSS) has been filed seeking following relief "It is, therefore, most respectfully prayed that this Hon'ble court may graciously be pleased to allow the present application and direct the Court concerned to execute the order dated 03.07.2024, passed by Principal Judge Family Court, Firozabad in Criminal Misc. Case No.767 of 2022 (Smt. Ruchi Sharma Vs. Prashant @ Pradeep Sharma), under Section 125 Cr.P.C., Police Station- Shikohabad, District-Firozabad within stipulated period, which has been decided by learned Principal Judge Family Court, Firozabad and / or may pass such other and further order, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case." 3. It is submitted by learned counsel for the applicant that applicant was awarded maintenance by the Principal Judge, Family Court, Firozabad vide order dated 03.07.2024 but no amount of maintenance has been paid to the applicant so far and thus, a direction may be issued to the Family Court concerned for execution of said order dated 03.07.2024. It was stated that so far no application under Section 125(3) Cr.P.C. / 128 Cr.P.C. has been filed. 4. In view of aforesaid, it is directed that in case applicant files an appropriate application under Section 125(3) Cr.P.C. / 128 Cr.P.C. or under relevant provisions of BNSS, as the case may be, within a period of four weeks from today, the same shall be considered and decided by the court concerned expeditiously in accordance with law. 5.
