Heard learned counsel for the applicants, learned AGA appearing for the State- opposite parties no.1 and 2 and Sri Gouliya Yadav, learned counsel who has filed power on behalf of opposite party no.3. 2. By means of this application, the applicants have prayed for quashing of the entire proceedings of Case Crime No.174 of 2025, under Sections 109, 352, 351(2) (3) of Bharatiya Nyaya Sanhita, 2023, Police Station Gosaiganj, District Sultanpur, pending in the court of Additional Chief Judicial Magistrate, Court No.21, Sultanpur. 3. After arguing at some length, learned counsel for the applicants states that he does not want to press this application on merit, however, he submits that liberty may be given to the applicants to file an application for discharge under the provisions of Cr.P.C., to which learned counsel for the opposite parties do not have any objection. 4. Accordingly, the applicants are granted liberty to file an application for discharge before the court concerned at the appropriate stage and the same shall be considered and decided by the court concerned in accordance with law. 5. With the aforesaid observations/directions, this application stands disposed of.
