HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 9077 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J.
HON'BLE MRS. BABITA RANI, J.
1. Heard learned counsel for the petitioner and learned AGA for respondents no.1 to 4.
2. Instant petition has been filed praying for a mandamus commanding the respondents to take action against the guilty police personnel/SHO Birendra Bahadur Singh and others for having violated the order passed by the Sub Divisional Magistrate dated 02.09.2025, a copy of which is Annexure-4 to the petition, whereby he had directed that there should not be undue interference upon the land of the petitioner.
3. The contention of learned counsel for the petitioner is that despite the aforesaid order being passed by Sub Divisional Magistrate the concerned SHO Birendra Bahadur Singh has got harvested the crop sown on the said piece of land although the consolidation proceedings are pending between the parties.
4. In case any order of the Sub-Divisional Magistrate has been violated by the authority concerned it would always be open for the petitioner to proceed in accordance with law but the present petition would not be maintainable.
5. Accordingly, the writ petition is disposed of leaving it open for the petitioner to pursue appropriate remedy as may be available to him. October 28, 2025 A.
