1. Heard Mr. P. Bordoloi, learned counsel for the petitioner as well as Mr. B. Sharma, learned Additional Public Prosecutor, Assam.
2. By this petition under Section 483 BNSS, the petitioner, namely, Shri Bhupen Hazarika, who was arrested on 16.08.2025 in connection with
Page No.# 2/2 Biswanath Chariali P.S. Case No. 151/2025 (corresponding to G.R. Case No. 416/2025) under Section 296/75/78/79 of the BNS, 2023 read with Section 66/67/(A) IT Act.
3. The allegation against the petitioner is that the being principal of his school he was sending of scene messages to the lady teachers of the school. Pursuant to the FIR, the petitioner was arrested and by now he has 14 spent days in custody. Although, learned Additional Public Prosecutor has objected to the prayer for bail. Having regard to the above, the nature of the allegation as well as the period of detention, the prayer for bail is allowed.
4. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of like amount to the satisfaction of learned Chief Judicial Magistrate, Biswanath subject to the following condition- i) That the accused petitioner shall not intimidate the witnesses or influence the investigation in any manner.
5. The bail application stands disposed of.
