THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH) Case No. : WP(C)/5312/2024 LONGJAM BIDYASAGAR SINGH S/O- L PREMJIT SINGH, A R/O WANGOI, LONGJAM LEIKAI, P.O AND P.S- WANGOI, IMPHAL WEST DISTRICT, MANIPUR-795134 VERSUS AIRPORTS AUTHORITY OF INDIA REP. A PHUKAN, MS S SARMA HAZARIKA Advocate for the Respondent : SC, A A I, MR. D DEKA,FOR CAVEATOR
BEFORE HONOURABLE MR. JUSTICE SUMAN SHYAM ORDER 17.03.2025 Heard Mr. A. Phukan, learned counsel appearing for the writ petitioner. Also heard Mr. C. Sharma, learned senior counsel assisted by Mr. D. Deka, learned
Page No.# 2/3 counsel appearing for the respondents. The writ petitioner herein had submitted his candidature for recruitment to the post of Junior Assistant in terms of the advertisement notice dated 30.12.2023 issued by the Airport Authority of India. However, on conclusion of the selection process, the petitioner was not appointed on the grounds that he did not meet the eligibility criteria of height and eye-sight as per the advertisement notice. Situated thus, the petitioner has approached this Court by filing this writ petition inter-alia contending that the respondents have committed an error in measuring and assessing his height as well as eye-sight thus, wrongfully ousting him from the realm of the selection process. Taking note of the petitioner’s grievance and in order to ensure that the candidature of the petitioner, in so far as his height and eye-sight is concerned, is evaluated through a fair and independent transparent mechanism, this Court, vide order dated 28.11.2024, had directed the Superintendent of the GMCH to constitute a special medical team of competent doctors so as to carry out the measurement of height and examine the eye-sight of the petitioner. Accordingly, a medical team of competent doctors was constituted, who had examined the petitioner and submitted report dated 05.12.2024, a copy whereof is available on record. From the report dated 05.12.2024 it appears that the writ petitioner is in fact deficient in terms of his height vis-à-vis the parameters laid down in the advertisement notice. His eye-sight was, however, found to be alright.
If that be so, there can be no doubt about the fact that the writ petitioner did not fulfil the eligibility criteria as laid down in the advertisement notice in so far as his height is concerned. Therefore, it cannot be said that the writ petitioner has
