HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10969 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The accused-applicant seeks bail in FIR/Case Crime No.651 of 2020 under section 302 and 120-B IPC, P.S. Shahabad, District Hardoi. 3. It is argued that the co-accused, with similar allegations, was enlarged on bail vide order dated 28.03.2022. The applicant is in custody since December 28, 2020. 4. It is further argued that the applicant was not even named in the FIR and was implicated only on the basis of a confessional statement. 5. Considering the pre-trial detention undergone by the applicant of about 5 years, and that the co-accused has been enlarged on bail, the applicant, having the criminal history of one case in which he has suffered imprisonment of one year, is entitled to bail. Thus the bail application is allowed. 6.
