Order 07/08/2025
1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.163/2025, registered at Police Station Bonli, District Sawai
[2025:RJ-JP:30516] (2 of 3) [CRLMB-6704/2025] Madhopur, for the offence(s) under Sections 318(4), 319(2), 111(2)(b) of B.N.S. and Section 66-C, 66-D of I.T. Act and Section 13 of Rajasthan Public Gambling Ordinance, 1949.
2.
Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. The accused- petitioners are in custody since 09.05.2025, there are no criminal antecedents against the accused-petitioners and there is no complaint made against the petitioners from the private person that the petitioners have duped or deceived any person and received money, therefore, the bail applications of the accused- petitioners may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of bail applications. It is contended that the accused-petitioners have created fake ID’s in their mobile phone and deceived public at large and also received money in their accounts, therefore, considering the nature of offence the bail applications of the accused-petitioners may be dismissed.
4. Heard and perused the material available on the record.
5. It is not desirable to express anything on the merits of the case, there are no criminal antecedents against the petitioners and the charge-sheet has already been submitted. The accused- petitioners are in custody since 09.05.2025 and trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely, 1. Ashish S/o Sh. Omprakash, 2. Ashish Alias Shera S/o Shyojilal and 3. Rajesh @ Pintu S/o Sh. Babulal, in
