The grievance of the petitioners in this writ petition is that the respondent-police are calling the petitioner, who is aged about 68 years, to the police station, at the behest of respondents 4 and 5 for settlement of a civil dispute pending between the petitioner and the respondents 4 and 5.
2. Learned Assistant Government Pleader for Home placed on record a copy of the written instructions of the Inspector of Police, Ananthapuram Rural Police Station, wherein it is stated that the petitioner was never summoned or asked to appear to the police station, at the behest of the respondents 4 and 5.
3. It is the specific case of the petitioner that he filed O.S.No.256 of 2008 on the file of Additional Senior Civil Judge, Ananthapuramu, for specific performance of an agreement against the respondents 4 and 5 and the same was decreed in favour of the petitioner. Later, an Execution Petition in E.P.No.53 of 2013 was filed for registration of a document by respondents 4 and 5 in favour of the petitioner. The petitioner, on affidavit, stated that he has been called to the police station for settlement. To buttress his contention, the petitioner filed a copy of the registered sale deed dated 24.08.2018 showing that he has been in possession of the property and he has got title over the property.
4. In view of the above facts and circumstances, the respondent-police are directed not to summon the petitioner in future to the police station for settlement of a civil dispute, at the behest of the respondents 4 and 5.
