CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 4 17-09-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending their arrest in Nawada P.S. Case No. 23 of 2024 registered under Sections- 341, 323, 324, 307, 302, 34 of the Indian Penal Code.
3. The informant is wife of the deceased. According to her fardbeyan, the co-accused Babloo Yadav called her husband on mobile and her husband went out from her house on 15-01-2024 but her husband did not return. On next day, he was found in an injured condition and later on, after 14 days, in course of treatment, he died.
4. It has been submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.10112 of 2025(4) dt.17-09-2025 2/2 the co-accused Babloo Yadav and Pankaj Yadav have been granted regular bail by this court. Learned counsel has further submitted that the case of the petitioners stands exactly on similar footing to that of co-accused Babloo Yadav and Pankaj Yadav.
5. On the otherhand, the learned Additional P.P. Sri Shailendra Kumar has submitted the co-accused persons have been granted regular bail whereas the present one is an anticipatory bail.
6. Considering the aforesaid facts and circumstances, the petitioners are directed to surrender in the court below and seek regular bail.
7. I see no reason as to why similar relief to that of co- accused Babloo Yadav and Pankaj Yadav could not be granted to the present petitioners.
8. With the aforesaid observations, this application stands
disposed of.
