VISHWAJITH SHETTY ORAL ORDER Accused Nos.5 and 7 in Crime No.211/2024 registered by Pulakeshinagar Police Station, Bengaluru, for the offences punishable under Sections 143, 144, 147, 148, 149 and 302 of IPC are before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.211/2024 was registered by Pulakeshinagar Police Station, Bengaluru, for the aforesaid offences against the petitioners herein based on the first information dated 29.06.2024 received from the Umesh E, ASI of Pulakeshinagar police station. During the course of investigation of the case, accused No.5 was arrested on - 4 - NC: 2025:KHC:13804 CRL.P No.3682/2025 C/W CRL.P No.3785/2025 01.07.2024 and accused No.7 was arrested on 03.07.2024 and subsequently remanded to judicial custody. After completion of investigation the charge sheet has been filed for the aforesaid offences against eight persons and the petitioners are arrayed as accused Nos.5 and 7 in the charge sheet. The bail application filed before the Jurisdictional Sessions Court in Crl.Misc.Nos.25071/2025 and 26138/2024 was rejected on 22.02.2025. Therefore, they are before this Court. 4. Learned counsel for the petitioners submits that petitioners do not have any criminal antecedents. Allegations against the petitioners and accused No.6 in the charge sheet is identical. Accused No.6 has been granted regular bail by this Court in Crl.P.No.13711/2024. Accordingly, prays to allow the petition. 5. Perusal of the material on record would go to show that allegation of assaulting deceased Vignesha with deadly weapons is as against accused Nos.1, 2, 3, 4 and 8. There is no allegation as against accused Nos.5 to 7 - 5 - NC: 2025:KHC:13804 CRL.P No.3682/2025 C/W CRL.P No.3785/2025 about they assaulting deceased with any deadly weapons. Accused No.6 has been granted regular bail by this Court in Crl.P.No.13711/2024. Undisputedly, petitioners also do not have any criminal antecedent. 6. Considering the aforesaid aspects of the matter and also having regard to the nature of allegations found against the petitioners, I am of the opinion that the prayer of the petitioners for grant of regular bail is required to be answered in the affirmative. Accordingly, the following: ORDER The petitions are allowed. The petitioners are directed to be enlarged on bail in in Crime No.211/2024 registered by Pulakeshinagar Police Station, Bengaluru, for the offences punishable under Sections 143, 144, 147, 148, 149 and 302 of IPC is before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, subject to the following conditions: - 6 - NC: 2025:KHC:13804 CRL.P No.3682/2025 C/W CRL.P No.3785/2025 a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
