The petition coming on for hearing, upon Perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri REDDY VENKATA RAMANA, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following; \ :-,:._€:v,:.:.-1-.,-i.:I;.:__?,-:i • ¢|' igivitELg£f3~=_`-i``k, |1` ` `-~ \ The Criminal Petition has been filed under sections 480 and 483 of the Bharatiya Nagarik Suraksha sanhita, 2023 (for brevity {the BNSS'), seeking to enlarge the petitioner/Accused on bail in Crime No.41 of 2025 on the file of Gopalapatnam police Sta{I|On, Visakhapatnam city, registered against the PetitI-Oner/Accused herein for the offences punishable under sections 85 and 108 ofBNS- 2. The case of the prosecution I-n nutshell is that on 14.02.2025, LW.1 Presented report stating that her deceased daughter's marriage was performed with the accused on o6.03.2024 as per their caste customs and after marriage, the deceased and accused were resided at Nandamuri Nagar, Gopalapatnam. By taking medicines for having sexual perversl'on, the accused harassed the deceased for sexual desire as per his wish and the deceased committed suicide by hanging due to harassment made by the accused both mentally and Physically. During l'nvestigation, the police arrested the accused on 14.02,2025 and the accused was sent to judicial custody. After completion of investigation, the police filed charge sheet. 3. Heard learned counsel forthe petitionerand the learnedAssistant Public Prosecutor. perused the record. 4. Learned counsel for the petitioner submits that the petitI-Oner has not committed any offence,I petitioner was falsely I'mPIl®cated by the police in the /- crime; petitioner would abide by any conditions to be imposed by this Court; and urged to allow the petition. 5. Learned Assistant Public Prosecutor submits that entire investigation was completed and charge sheet is filed. 6. In view of the above facts and circumstances of the case and since 14.02.2025, the petitioner is in judicial custody, this Court is inclined to grant bail to the petitioner, on the following conditions. (i) The petitioner shall be released on bail by executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned ll Additional Chief Judicial Magistrate, Visakhapatnam. (ii) On release, the petitioner shall appear before the Station House Officer, Gopalapatnam Police Station, Visakhapatnam District, once in a week i.e., on every Sunday between 10.00 a.m. and 01.00 p.m., for a period of 3 months. (iii) The petitioner shall not directly or indirectly contact or threaten the witnesses under any circumstances and any such attempt shall be construed as an attempt of influencing the witnesses and shall not tamper evidence and shall co-operate with the investigation. It is made clear that the petitioner shall scrupulously comply with the above conditions and breach of any of the above conditions will b6 viewed seriously and prosecution is at liberty to move ap application for cancellation of the bail. 7. A6cordingly, the Criminal Petition is allowed.
