This writ petition has been filed by the petitioner with the following main prayers:- "To issue a writ, order or direction in the nature of MANDAMUS commanding and directing the Opposite Parties No. 2 to 4 to take legal action against the Opposite Parties No. 5 and 6 who are demanding illegally possession to the petitioner's House No. 511 situated in Village- Jakriya, Majre-Budhwara, Pargana-Pratapganj, Tehsil-Nawabganj, District-Barabanki, during the pendency of this writ petition contained as Annexure No. 1 in the interest of justice. 2. To issue a writ, order or direction in the nature of MANDAMUS commanding and directing the Opposite Parties No. 2 to 6 Oath Commissioner to not make any disturbance in peacefully possession of the petitioner House No. 511 situated in Village-Jakriya, Majre-Budhwara, Pargana-Pratapganj, Tehsil-Nawabganj, District-Barabanki without taking any legal process under due course of law in the interest of justice." 3. Upon hearing counsel for the parties, we are of the view that since there is alternative efficacious remedy available, the petitioner should be Versus Counsel for Petitioner(s) : Rajesh Kumar Kashyap Counsel for Respondent(s) : C.S.C., Vinay Shankar Malti Devi .....Petitioner(s) State Of U.P.
