HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9987 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Ashish Kumar, the learned counsel for the petitioner, Sri Vikas Rai, the learned State Counsel appearing on behalf of the opposite parties no.1 to 4, Ms. Ruby Choudhary, the learned counsel for the opposite party no.5/State Bank of India.
2. By means of the instant petition filed under Article 226 of the Constitution of India the petitioner has sought quashing of the proceedings for recovery of loan taken by petitioner's husband from State Bank of India. The petitioner admits that her husband had taken loan and she admits the liability of repayment but she contends that she could not repay the loan amount in time due to financial constraints.
3. The learned counsel for the petitioner has prayed that the petitioner may be granted the facility of repayment of loan amount in easy installments.
4. Opposing the request, the learned counsel for the respondent- Bank has stated that the petitioner was granted liberty to repay the loan amount in instalments by means of an order dated 23.01.2025, passed by a Coordinate Bench of this Court in Writ-C No.671 of 2025 filed by her. When the petitioner failed to comply with the order the time granted to her for depositing the first instalment of Rs.40,000/- which was extended by means of an order dated Versus Counsel for Petitioner(s) : Ashish Kumar Counsel for Respondent(s) : C.S.C., Ruby Choudhary Smt. Nirmala Devi .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko And 4 Others .....Respondent(s)
01.04.2025 but even the first instalment has not been deposited by the petitioner as per the order dated 23.01.2025, passed in Writ-C No.671 of 2025.
5. As the petitioner admits her liability of repayment of loan amount and as she has earlier been granted facility of repayment of loan amount in instalments and she has failed to comply with the order passed by this court granting her liberty to repay the loan amount in instalments there is no good ground to accede to the same request in this second petition filed by the petitioner with the same purpose.
6. The petition is accordingly dismissed. October 17, 2025 Ram.
