Order 28/05/2025
1. Earlier when these matters came up on board on 23.05.2025, following order was passed:-
“1. In these writ petitions, petitioners are claiming exemption to clear the Common Eligibility Test to apply for the post of Constable (Band) pursuant to advertisement dated 09.04.2025, alleging inter alia that as per advertisement, there is neither written examination nor interview for recruitment on the post of Constable (Band),
[2025:RJ-JP:22402] (3 of 3) [CW-8027/2025] hence, on such analogy, aspirants for the post of Constable (Band) should be exempted to clear the CET as well.
2. Counsel for petitioner admits that essential requirement to clear CET for the post of “Constable” to be recruited under Rajasthan Police Subordinate Service Rules, 1989, has been held mandatory, as envisaged under Rule 6 & Schedule II of Rajasthan Subordinate and Ministerial Services (Common Eligibility Test) Rules, 2022.
3. In view of above, counsel for petitioner seeks permission to move an appropriate application to amend these writ petitions to challenge the Rules of 2022 to such extent and to convert these writ petitions into D.B. Civil Writ Petitions.
4. Let needful be done.”
2. Counsel for petitioners, having instructions of petitioners, seeks permission to withdraw these writ petitions with liberty to file afresh before the Division Bench.
3. Respondents have no objection.
4. Accordingly, the writ petitions are allowed to be withdrawn with the liberty as prayed for.
5. Stay applications and pending application(s), if any, stand
disposed of.
