“10.1 That, this Hon'ble Court may kindly be pleased to call the entire records pertaining to case of petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondents no. 3 & 4 to take appropriate action against the respondents no. 5 & 6 for their removal from the government land/pathway being used by the petitioner. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”
2. Learned counsel for the petitioner submits that respondents No.5 & 6 are illegally possessing the government land bearing Khasra No.111 situated at Village Bakarkatta, which is in front of the land of the petitioner
3 bearing Khasra No.112, 113 and 114 total ad measuring area 50 decimals. The petitioner is running a gas agency in the name of Bakarkatta Bharat Gas Agency. The petitioner is using the said land as a main road, which the respondent is creating hurdles without any authority, as such, he has moved an application on 30.12.2024. Lastly, he prays that a direction has been issued to the concerned Tahsildar to look after the matter and to pass an appropriate order. 3.
Considering the facts and circumstances of the case, the Tahsildar Salhewara is directed to consider the application which was filed way back on 30.12.2024 and to pass an appropriate order in respect of the application made by the petitioner. 4. It is made clear that this Court has not passed any order on the merits of the case, however, it is equally considerable that the concerned Tehsildar is required to consider the application and pass an appropriate order. It is further surprising that the concerned Tehsildar has kept the matter pending for a long period, he cannot keep the matter pending before him for long and it could be decided within some short period. 5. Accordingly, the concerned Tahsildar is directed to decide the application dated 30.12.2024 within 15 days from the date of receipt of a copy of this order. 6. With the aforesaid observation(s) and direction(s), the present petition stands disposed of. Sd/- (Amitendra Kishore Prasad)
