HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 4828 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard Shri Arpit Singh, learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.159 of 2023, under Sections 302 and 34 IPC, Sections 3/25 Arms Act, P.S. Unchahar, District Raebareli. 3. Learned counsel for the applicant argues that this is the second bail application. The first bail application was rejected on 10.1.2024. While arguing the second bail application learned counsel for the applicant argues that 3 of the co-accused against whom allegation of causing gunshot injury was alleged have been enlarged on bail by this Court vide separate orders. The office reports on record sent by the trial court indicates that three of the prosecution witnesses have been examined and the examination of fourth witness is going on. 4. Learned AGA has opposed the bail application. 5. Considering the fact that the role of firing was not assigned to the applicant and the co accused enlarged on bail was assigned the specific role of causing the firearm injury coupled with the fact that there is no likelihood of the trial being concluded in the near future, however, without commenting upon the merits of the case, the applicant who is in jail since 6.4.2023 having no criminal antecedents is entitled to be enlarged on bail on the ground of parity. In view thereof, the application Versus Counsel for Applicant(s) : Arpit Singh, Nasrul Hasan Counsel for Opposite Party(s) : G.A. Mohit @ Motu Lodh .....Applicant(s) State Of U.P. Thru. Addl.
