After hearing the learned advocate for the applicant for some time, when this court expressed disinclination to interfere in the impugned order, at that time, the learned advocate for the applicant, on instructions, submitted that the applicant does not wants to proceed with the revision application, as such seeks leave to withdraw the same with liberty to file a fresh application under section 319 of the Cr. P. C. before the learned trial court, as after passing the order, the evidence of PW-5- Dhondiba, a Panch witness of the CCTV footage, was recorded. Having considered his submissions and the fact that after the passing of the order, the prosecution examined PW-5 panch, a witness to the CCTV footage who supported it, and the panchanama was exhibited as Exh. 124 and 153. 4.
