The learned counsel for the applicant has submitted that during the pendency of this interlocutory application, which was filed under section 5 of the Limitation Act, the appellant, i.e. the New India Assurance Company Ltd. as well as the workman, namely, Mafijul Islam (respondent no.1) have arrived at a negotiated settlement of the entire claim of the respondent no.1. 3. It is seen that he has received instruction from the New India Assurance Company Ltd., the applicant, that in terms of the settlement, the applicant has agreed to withdraw this interlocutory application. A photocopy of the said instruction is retained on record. 4. Accordingly, this interlocutory application stands dismissed on withdrawal. 5.
