HARI HARANADHA SARMA PETITIO NNO: CRIMINAL ORDER: This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant Of Pre-arrest Bail. The petitioners are arrayed aS Accused Nos.1 and 2 in cr.No.41 of 2025 of Golugonda Police Station, Anakapalli, visakhapatnam District, Which Was registered With the allegation of committing the offences under sections 118(1) r/w 3 (5) of Bharatiya Nyaya Sanhita (BNS). Subsequently, by Way Of alterat'lon memo the offence under section 118(2) of the Bharatiya Nyaya Sanhita (BNS) was added. 2.
The petitioners/Accused Nos.1 and 2 pray for directions tO release on Bail, in the event Of arrest. 3. The name Of the Petitioner/accused mentioned against column No.7 in the FIR format d'lfferS from the name mentioned in the report enclosed to the FIR. The petjtl-oners, while denying the aIIega{jons made jn the complaint, submit that the dispute, even as per the contents of the complaint, pertaI-nS tO lease Of a Premises, and the incident is stated to have occurred during the course of discussions between the landlords and the tenants. 7. The case of the prosecution, lan brI-ef, iS that informant one K. Thatababu lodged a complaint with the police stating that a meeting was arranged before the elders between landlords and tenants, and durI-ng the course of the said djscussl'ons, the petitioners acted in a highhanded manner and caused I-njury to the brother of the de-facto complainan{ with a stone causing injury to knee. Hence, the petitioners/accused Nos.1 and 2 are liable for prosecution and punishment for the offence under which the case has been registereQ' +t,J. `-`p

The learned COunSel for the Pet'ltiOnerS Submitted that Accused No.2 had also lodged a complaint, wh'lCh Was reg'lStered as cr'lme No.42 of 2025 on the file Of the Same POliCe Station, for the offences punishable under sections 74, 79, 118(1), and 115(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, wherein the informant in the Present Case and Others have been arrayed as accused. l{ is subm'ltted that, in fact, the petitioners are the victims.
The learned COunSel further Submitted that though the original lease period was for five years, the same was unilaterally reduced to two years and when the petitioners sought the return of the investment made by them that led to disputes. It is submitted that despite the differences, the petitioners have already vacated the premises in question. 9. Learned Assistant Public Prosecutor, formally opposed the ba" application contending that the allegations are well founded and the petitioner does not deserve grant of pre-arrest bail. 10. Upon considering the facts and C'lrCumStanCeS Of the Case, the nature and depth of the allegations, the prayer for grant of pre-arrest bail found convincing. ll. ln the result, the crim]'nal petI-lion jS allowed, on the following conditions: i) petitioners/Accused Nos.1 and 2 are directed to appear before the concerned station House officer with[-n two (o2) weeks and on such appearance/surrender or arrest, they are entitled for release on bail, jn respect of cr.No.41 of Golugonda poll-ce stat['on, AnakapaII[', VI'Sakhapa{nam Djstrjct, whI-Ch Was registered with the aIIegatI'On Of COmmI'ttjng offences under sectI'OnS 118(1) I/w 3 (5) of Bharatjya Nyaya sanh[-{a (BNS), on the condI-lion Of the petI'tiOner/Accused Nos.1 and 2 executing ba" bond for Rs.20,000/- each with two sure{jes for a like sum to the satisfaction of the s.H.O., Golugonda police Station. iI-) The petitioners/Accused Nos.1 and 2 and their sureties shall furnI®Sh {hejr permanent resI|dentjal address detal®ls and identity particulars to the concerned police and keep the poll'ce informed about the change in address, jf any, time to time.
