Heard learned counsel for petitioner and learned State counsel for opposite parties. 2. The present petition has been filed seeking the following main relief:- "(i). To issue a writ, order or direction in the nature of Mandamus commanding the Opposite Parties to regularize the service of the petitioner under Uttar Pradesh Regularization of Persons Working on Daily Wages or On Work Charge or On Contract in Government Departments On Group 'C' and Group 'D' posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 2016. (ii). Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no.2 to forward the name of the petitioners to the respondent no.1 for payment of minimum of pay scale as has been forwarded vide letter dated 15.05.2020 & 19.09.2022 contained as Annexure No.4 & 5 to this petition." 3. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to file a fresh representation before opposite party No.2 i.e. Director, Horticulture & Food Processing, Uttar Pradesh, Lucknow. In case such a representation is filed, the same shall be decided within Versus Counsel for Petitioner(s) : Mohd. Ateeq Khan Counsel for Respondent(s) : C.S.C.
