The present contempt application has been preferred for alleged non compliance of the order dated 19.06.2025 passed by the Commissioner, Lucknow Division in Appeal No. 4870/2024, computerised case no. C202410000004870. The relevant extract of the same is quoted hereinbelow:- "उपरो्व िववेचना के ्ऺकाश में अपील आंिशक रूप से स्वीकार की जाती है तथा उपिजलािधकारी, पुरवा उन्नाव ्षारा पािरत आदेश िदनांक 18.10.2023 को उ० ्ऺ० जोत चकबंदी अिधिनयम, 1953 की धारा 48 (3 ) के अधीन आवेदन दािखल करने हेतु अपीलकतार् को िनदरॏिशत करने के िवस्तार तक अपास्त िकया जाता है। यह ्ऺािवधािनत है की अपीलकतार् के आवेदन को सुसंगत धारा के अधीन दािखल िकया जाना माना जायेगा और उसे िजला मिजस््िेट, उन्नाव ्षारा इस आदेश की ्ऺमािणत ्ऺित ्ऺाप्त होने के एक माह की अविध के भीतर सम्बंिधत ्ऺािधकारी को अ्षसािरत िकया जायेगा तदोपरांत एक माह के अंदर ्ऴुिट को संशोिधत करेगा। आदेश की एक ्ऺित उपिजलािधकारी, पुरवा उन्नाव को भेजी जाये। बाद आवश्यक कायर्वाही इस न्यायालय की प्ऴावली दािखल दफ्तर हो।" Learned counsel for the applicant has submitted that the compliance of the aforesaid order is not being made by the respondents. After hearing learned counsel for the applicant and going through the record of the case, it is found that the Commissioner, Lucknow Division has decided the appeal of the appellant (present applicant) but it is not implemented and executed till date, as per the submission made by learned counsel for the applicant. For execution/implementation/compliance of the order passed under Section 38(4) of the U.P. Revenue Code, 2006, the applicant has a remedy to file an application under para 460 of the U.P. Revenue Court Versus Counsel for Applicant(s) : Anand Kumar Singh, Karuna Shankar Bajpai Counsel for Opposite Party(s) : Ram Narayan .....Applicant(s) Gaurang Rathi Distt. Magistrate / Collector Unnao And Another .....Opposite Party(s) Manual. In view of the aforesaid, the present case is devoid of merit, hence dismissed.
