1. The petitioner has filed this Petition seeking indulgence of this Court under Article 226 of the Constitution of India for action against respondent No.4 (Sub-Divisional Magistrate, Kusmi, District Balrampur- Ramanujganj) for that an application/complaint dated 19.12.2024 has been filed. 2. The petitioner, in this Writ Petition, has prayed for the following reliefs:-
“10.1 That, this Hon'ble Court, may kindly call for the entire record in relates to the case of the Petitioner. 10.2 That, this Hon'ble Court, may kindly be pleased to issue writ/writs, order/orders, direction/directions, to direct the Respondent No.03 (Collector, Balrampur Ramanujganj) to decide the complaint filed by the Petitioner vide Annexure P-1 and take appropriate action step, in the interest of justice. 10.3 That, any other relief, this Hon'ble Court, deem fit and proper may also kindly be granted to the Petitioner, in the interest of justice.”

From perusal of the complaint, it seems that the petitioner is an Editor of one Azizi 24 News and he is having doubts that since the petitioner is raising objections in respect of the work and performance of the concerned SDO, as such, the SDO bent upon to give lessons to him. When a complaint was filed, the concerned Commissioner directed the Collector to look after the complaint in accordance with law. Against this, the petitioner is seeking relief that the Collector, Balrampur-
3 Ramanujganj be directed to decide his complaint filed against the SDO (Revenue), District Balrampur- Ramanujganj. 4.
Learned counsel for the respondent/State objects the maintainability of the petition, stating that when the petitioner filed a complaint before the concerned authority, he should have waited for necessary action to be taken by the authorities, however, without waiting for the decision, he has rushed to this Court. It seems that the petitioner is having grudge against the respondent/Sub-Divisional Magistrate, Kusmi, District Balrampur- Ramanujganj, therefore, the petition is liable to be dismissed while imposing cost upon the petitioner as he is misusing the process of the Court. 5. I have heard learned counsel for the parties and perused the record as well as the complaint. 6. From the complaint, it seems that the petitioner is seeking transfer of the concerned SDO only on the basis that he is having doubt that the SDO will take action against him and till date no action has been taken by the concerned SDO, which can be said to be illegal. 7. Resultantly, the Petition being bereft of any merits or substance is liable to be and is hereby dismissed at the threshold. Sd/- (Amitendra Kishore Prasad)
