BABUJI TENNETI COUNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER J`J TCDS,J CRLP.No_5715/2025 The Court made the following ORDER: The present Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, by the Petitioner for granting of anticipatory bail in connection with crime No.241 of 2025 on the file of the prohibition & Excise Station, Rajamahendravaram South, East Godavari District, registered for the offences punishable under Sections 7-B r/w 8-B of the Andhra Pradesh Prohibition (Amendment) Act, 2O20. 2. It is the case of the prosecution that the Prohibition & Excise Inspector and his staff conducted raid on 10.05.2O25 at about 4:30 a.m., at Dowleswaram Sachivalayam of Rajamahendravaram Rural Mandal and found one person coming on a motor cycle with a white colored mica gunny. bag kept on the motor cycle petrol tank. When the police tried to stop the Vehicle, the person perturbed and ran away by leaving the motor cycle and white COlOred mica gunny bag. It is the further case of the prosecution that the Prohibition & Excise Inspector and his staff checked the white colored mica gunny bag and found 35 liters of lD liquor in 7 polyth6ne covers each containing about 5 liters of lD Liquor. It is the further case of the petitioner that the Prohibition & Excise Inspector identified ran away person as the petitioner and lodged a case against him. 3. On the other ham_d, learned counsel for the petitioner would submit that the petitioner is=not present at the scene of offence and he was falsely implicated in the said crime. Per contra, learned Assistant Public Prosecutor opposed the bail applicatI'On On the ground that the petitioner is a habitual offender and in the event of his release on bail, it is very diffI'Cult tO Secure his Presence. 5. Having considered the submissions made by both the learned counsel, this Court is inclined to allow the present criminal petition with the followI-ng conditions: i) ln the event of arrest of the petI-tI'Oner, the petitioner shall be enlarged on baI'l On executing a Personal bond for a Sum Of Rs.10,000/-(Rupees ten thousand only), with two sureties each for like sum to the satisfaction of the Prohibition and Excise Inspector, ProhI-bitI'On & Excise Station, Rajamahendravaram south, East Godavari District; ii) The petI'tI'Oner Shall make himself available for investigation as and when required; iii) The petitioner shall not cause any threat, inducement or promise to the PrOSeCutI'On Witnesses; 6.
