Respondents Petition under Sections 482 of BNSS (old 438 of Cr.P.C), praying that in the circumstances stated-in the affidavit filed in support of the criminal Petition, the High Court may be pleased to grant anticipatory bail to them in the event of their arrest in Crime No:36 /2025 U/s.118(1), 351(3), 331(5) r/w.3(5) of BNS on the file of Dagadar{hi Police Station, S.P.S.R. Nellore District. The petition coming on for hearing, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of DR G V RAVl, Advocate for the petitioners and of PUBLIC PROSECUTOR for the Respondent No.1 and the Court made the following; 2 TCDS,J CRLP.No.5720/2025 The Court made the following ORDER: The present Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, by the petitioners for granting of anticipatory bail in connection with Crime No.36 of 2025 on.the file of the Dagadarthi Police Station, SPSR Nellore District, registered for the offences punishable under Sections 118(1), 351(3), 331(5) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. It is the case of the prosecution that the de facto complainant along with others were cleaning around the flag pole on 06.04.2025 at about 8:00 a.m., the Accused Nos.1 {o 8 went there wI'th Sticks, rods and a{ta;ked the de faCtO complainant. On the report given by the de facto complainant, the present crime was registered. 3. Learned counsel for the petitioners would submit that the injuries sustained by the de facto complainant are simple |ln nature and he did not involve in the crime as alleged by the de facto complainant. He would also submit that all other accused including Accused No.1 were released on bail. He would further submit that the petitioners were not present at the scene of offence and they were falsely implicated in the said crime. He would further submit that the petitioners are the sole breadwinners of their family and the petitioners would abide by any conditions that may be imposed by this Court in the event of grant of anticipatory bail and urged to allow the petition. _rfu `-/ \_a 3 TCDS.i CRLP. On the other hand, learned Assistant Public Prosecutor fairly submitted before this court that the inJ-urieS Sustained by the de facto complainant are simple in nature and did not dispute the fact that all other accused are released on bail. He would further submit that the investigation I-S yet tO be completed and some more witnesses are to be examI-ned. 5. In,view of the fact that otheraccused were released on bail and having considered the submissions made by both the learned counsel, this Court is inclined to allow the present criminal petition with the following conditions.- i) In the event of arrest of the petjtjoners, the petitioners/Accused Nos.2 & 8 shall be enlarged on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties each for like sum to the satisfaction of the sub-Inspector, Dagadarthi poll-ce Station, spsR Nellore District,- I-i) The petitioners shall make himself available for investigation as and when required,I iii) The petitioners shall not cause any threat, induce or promise to the Prosecution Witnesses,- 6.
