Heard Mr. Mohit Prakash, learned counsel for the appellant and Mr. Rakesh Kumar Sinha, learned Addl. Public Prosecutor appearing for the State. 2. This appeal is directed against the order dated 13.06.2025 passed by the learned Additional Judicial Commissioner XVIII-cum-Special Judge, ATS, Ranchi in connection with ATS Court Case No. 01 of 2025 corresponding to ATS P.S. Case No. 04 of 2024, whereby and whereunder the prayer for bail of the appellant has been rejected. 3. It has been alleged that one Avinash Kumar who was the member of Aman Sahu Gang had threatened the Jail Superintendent. Based on the disclosure of Avinash Kumar, a raid was conducted in the house of one Roshan who had also confessed of terrorizing the Jail Superintendent. 4. Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 13.07.2024. It has further been submitted that the appellant has been implicated on the basis of confessional statement of co-accused Roshan Kumar. 5. Mr. Rakesh Kumar Sinha, learned APP appearing for the State has opposed the prayer for bail of the appellant. 6. Regard being had to the manner of the implication of the appellant and period of custody undergone by him, we while setting aside the order dated 13.06.2025 passed by the learned Additional Judicial Commissioner XVIII-cum-Special Judge, ATS, Ranchi in connection with ATS Court Case 2025:JHHC:21351-DB 2 Cr. A. (D.B.) No. 804 of 2025 No. 01 of 2025 corresponding to ATS P.S. Case No. 04 of 2024, direct the appellant to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount, to the satisfaction of Learned Additional Judicial Commissioner XVIII-cum- Special Judge, ATS, Ranchi. 7.
